Turkey China photovoltaic module anti-dumping case launched anti-circumvention investigation
On November 25, 2023, the Ministry of Trade of Turkey issued Announcement No. 2023/32, saying that in response to the application of Turkish enterprises, photovoltaic modules originated in China (Turkish: bir modul halinde birle, tirilmi, veya panolarda duzenlenmi, fotovoltaik hucreler) anti-dumping case initiated anti-circumvention investigation, To examine whether the Chinese products involved were exported to Turkey via Vietnam, Malaysia, Thailand, Croatia and Jordan to avoid anti-dumping duties. The investigation period of this case is the whole year of 2020, the whole year of 2021, the whole year of 2022, and the period from January 2023 to September 2023. The products involved include photovoltaic cell modules and solar panels, involving products under the Turkish Tax Code 8541.43.00.00.00. The announcement shall take effect as of the date of promulgation. According to the relevant Turkish law, Turkey can retroactively impose anti-dumping duties within 90 days before the final ruling.
Interested parties should submit questionnaires, case comments and evidentiary materials within 37 days from the date of the announcement.

On July 1, 2016, Turkey launched an anti-dumping investigation against photovoltaic modules originating in China. On April 1, 2017, the former Ministry of Economy of Turkey issued Announcement No. 2017/6, making a positive final ruling on the case, imposing anti-dumping duties of $20 / square meter and $25 / square meter on the products involved, valid for five years. On March 26, 2022, the Turkish Trade Ministry issued Notice No. 202/10, launching the first sunset review investigation into the case. On September 15, 2023, the Turkish Ministry of Trade issued Announcement No. 2023/26, making the first positive final ruling on the case, and continuing to impose anti-dumping duties of $20 / m2 and $25 / m2 on the products involved.
